NanoBanana Play 利用規約

Article 1 (Application)

These Terms define the conditions for using the NanoBanana Play AI image generation service (the “Service”) provided by BenriWorks (“we,” “us,” or “our”). Users are deemed to agree to these Terms when using the Service.

Article 2 (Definitions)

1. “User” means any individual or legal entity that uses the Service.
2. “Credits” are internal points required to access functions such as image generation.
3. “Generated Images” are image data created through the Service.

Article 3 (Eligibility)

1. The Service is available only to users aged 18 or older in accordance with Google’s API Terms of Use. Users under 18 may not use the Service.
2. The Service is intended for users located in Japan. Access or use from outside Japan is prohibited except in exceptional circumstances.

Article 4 (Service Description)

1. The Service uses Google’s Gemini API to generate images based on user-provided text prompts.
2. Some features require the consumption of credits.
3. The outputs are automatically generated by AI. We do not guarantee their accuracy, completeness, or originality.

Article 5 (Data Handling)

1. We do not view, analyze, or store the images users upload or generate.
2. We retain only the minimum logs required to operate the Service (prompts, error information, credit consumption records, etc.).
3. Under the Gemini API specification, content submitted by users and generated results are not used by Google for model training, though this policy may change without notice at Google’s discretion.
4. We never provide or sell user data to third parties.

Article 6 (Credits and Billing)

1. Users can access the Service by purchasing credits.
2. Credits are sold via Stripe, and the unit and price are determined by us (for example, 20 credits for JPY 300, tax included).
3. Credits are granted immediately after purchase and cannot be returned, refunded, or transferred.
4. Credits expire 180 days after the most recent purchase. Unused credits after expiration become invalid.
5. If credit consumption fails due to generation errors, we may provide compensation after confirmation.

Article 7 (Prohibited Conduct)

Article 8 (Rights to Generated Images)

1. Copyright in generated images generally belongs to the user.
2. Users are responsible for any infringement of third-party rights arising from the prompts or images they submit.
3. We may use anonymized, aggregated usage data for internal analysis to improve the Service, but individual prompts and image content are excluded.

Article 9 (Disclaimer)

1. We do not guarantee the accuracy, quality, or fitness for any particular purpose of generated content.
2. We are not liable for any damages resulting from interruption, suspension, or termination of the Service.
3. Disputes between users or with third parties must be resolved by the parties themselves.

Article 10 (Suspension and Termination)

We may change or discontinue the Service without prior notice. Changes take effect when announced within the Service.

Article 12 (Governing Law and Jurisdiction)

These Terms are governed by the laws of Japan. The district court with jurisdiction over our headquarters has exclusive primary jurisdiction.

Credit usage varies depending on the operation, model, and resolution. The following table summarizes the current reference values.
